Full Release & Legal Agreement
In consideration for being permitted to enter and remain on the premises of Putt Street Social, LLC and to participate in miniature golf and related recreational activities (the "Activities"), I, the undersigned, for myself and on behalf of my heirs, executors, administrators, assigns, personal representatives, and next of kin, knowingly and voluntarily assume all risks of injury, illness, death, property damage, or other loss arising out of or related to my participation in the Activities or presence on the premises.
I acknowledge that the premises may contain conditions including but not limited to wet or slippery floors, dim lighting, elevated or uneven surfaces, crowded areas, and other hazards, whether known or unknown, and I voluntarily assume all risks associated with such conditions. I understand that risks may be both known and unknown, obvious and non-obvious, and I voluntarily assume all such risks.
These risks include but are not limited to slips, trips, falls, collisions, contact with golf clubs or balls, negligent acts of other participants, negligent supervision, or equipment malfunction.
I acknowledge that alcohol may be served on the premises and that alcohol consumption may impair judgment, coordination, and reaction time. I am solely responsible for my decision to consume alcohol, my level of impairment, and my conduct, and I accept full responsibility for any injuries, damages, or harm to myself or others resulting from my consumption of alcohol.
I agree that compliance with all posted rules, staff instructions, and safety guidelines is a condition of my participation, and failure to comply may result in removal from the premises without refund. Putt Street Social, LLC reserves the right to refuse service or remove any individual at its sole discretion for safety, policy, or conduct reasons.
To the fullest extent permitted by the laws of the State of Ohio, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Putt Street Social, LLC, its members, managers, owners, officers, employees, agents, insurers, affiliates, event hosts, contractors, landlords, and representatives (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, damages, liabilities, costs, or expenses of any kind whatsoever, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, except for conduct that constitutes willful or wanton misconduct under Ohio law.
I further agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, including attorney's fees and costs, arising out of or related to my conduct, participation, or presence on the premises.
I certify that I am at least eighteen (18) years of age and legally competent to sign this agreement, or that I am the parent or legal guardian signing on behalf of a minor participant and agree to bind both myself and the minor to its terms.
I agree that this Release is intended to be as broad and inclusive as permitted by Ohio law. If any portion is held invalid, the remainder shall continue in full force and effect. I agree that exclusive venue and jurisdiction for any dispute shall lie in Stark County, Ohio.
I agree that this agreement may be executed electronically and that my electronic signature shall have the same legal effect as a handwritten signature.
I acknowledge that I have carefully read this Waiver and Release of Liability, understand its contents, and sign it voluntarily with the intent to be legally bound.
